Following her attack, she gave up hope for waging any charges against the man for the country's legal system seemed to be hopelessly corrupt and useless in finding her solace and compensation. So instead of harboring hate against the Judge who attacked her, she instead wishes to warn the masses of India of such horrors and save other young girls from falling victim to such horrific experiences.
In addition, this intern's story has led to the proposal of laws that create stricter protection of female lawyers from dangerous male counterparts, as well as laws that redefine sexual harassment and rape to include unwanted sexual messages and stalking. Any cases of sexual harassment will also be created by a newly created Gender Sensitization and Internal Complaints Committee.
1) What kind of justice is involved and being violated here? What human rights?
2) What other actions would further reduce to sexual harassment and rape of women across India?
There are two kinds of justices that are involved and violated. I think that distributive justice and legal justice are both involved and violated. Distributive justice is involved because society definitely did not do its duty in protecting this girl’s rights. In addition, legal justice is involved because the man who raped the girl and the many other men who have raped other women are breaking the law. Beyond the fact that the man broke the law, this incident is horrific and disturbing and it is very sad that this is a common occurrence around the world, specifically in India. Furthermore, the fact that the government has not done much since this girl’s experience and many other girls’ and women’s experiences is disturbing and not right. There were many human rights that were violated by this tragedy; however, some of the main human rights violated are the right to security of the person, the right to be equal in front of the law, the right to never be abused, and the right to one’s dignity. The government should be enforcing stricter laws and should be reforming their laws so that no woman should ever have to go through the experience that the girl in this article had to go through.

ReplyDeleteThis article really strikes me because I wrote my research paper on this exact topic in India. It is such a prevalent issue and the government takes hardly any steps to fix it. I think that distributive justice is being violated here because the government is not fulfilling its duties that it has toward its people. One among many human rights that are being violated is the right to security. It is very sad that these women cannot even do their job without having to be worried about the dangers of male counterparts. India needs stronger rules to be implemented and harsher means of punishing people to show that sexual harassment of women is wrong.
